Operator & Legal Entity
PastSmallTalk is operated by May Software Inc. (“May”, “May, Inc.”), the legal entity responsible for the service. All references to “PastSmallTalk”, “we”, “us”, or “our” in these Terms refer to May Software Inc. Corporate information is available at may.inc.
Acceptance of Terms
By accessing and using the services provided by PastSmallTalk, you agree to be bound by these Terms of Service (“TOS”). If you do not agree to these terms, please do not use our services.
Description of Service
PastSmallTalk provides card games to connect past small talk. Create custom cards, or use curated game packs.
Use of Service
You agree to use PastSmallTalk's services only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the service.
PastSmallTalk grants you a non-exclusive, non-transferable, limited right to access and use the services for your personal, non-commercial purposes, subject to these TOS.
User Conduct
You are solely responsible for any content you create, transmit, or display while using PastSmallTalk's services and for the consequences of your actions.
You agree not to upload, communicate, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
Intellectual Property
You retain all ownership rights to the content you create or upload. However, by using PastSmallTalk's services, you grant PastSmallTalk a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display the content in connection with the service.
PastSmallTalk owns all rights to the software, applications, and intellectual property related to the service.
PST+ Subscription & Fair Use
PastSmallTalk offers a paid subscription tier (PST+) that unlocks additional features including unlimited game creation, additional saved vibes, custom game retention, and access to exclusive deck categories.
“Unlimited” game creation on PST+ is subject to a fair-use soft limit of 500 games per week to prevent automated abuse. Users who reach this limit in good faith can email team@pastsmalltalk.com to have it lifted at no additional cost.
Subscriptions are billed through Paddle, our merchant of record. You may cancel your subscription at any time. Upon cancellation, your PST+ features remain active until the end of your current billing period.
Termination
PastSmallTalk reserves the right to terminate your access to the services without notice for any breach of these TOS.
Disclaimer of Warranties
The services are provided “as is” and “as available” without warranty of any kind, either express or implied. PastSmallTalk does not guarantee that the service will meet your requirements or be available on an uninterrupted, secure, or error-free basis.
Limitation of Liability
PastSmallTalk shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from your use of the services.
Indemnification
You agree to indemnify, defend, and hold harmless PastSmallTalk, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the services, or your violation of these TOS.
Severability
If any provision of these TOS is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement
These TOS, together with our Privacy Policy, constitute the entire agreement between you and PastSmallTalk regarding the services and supersede any prior agreements.
Changes to Terms
PastSmallTalk reserves the right to modify these TOS at any time. Your continued use of the service after such changes constitutes your acceptance of the new TOS.
Governing Law
These TOS and your use of the services are governed by the laws of the jurisdiction where PastSmallTalk is established, without regard to its conflict of law provisions.
